Subject to your complete and ongoing compliance with these Terms, Skizzium grants you a personal, non-transferable, non-exclusive, revocable, limited license to: (a) install and use a copy of our desktop application associated with the Services that is obtained from a legitimate source; and (b) access and use the Services. We reserve all rights not expressly granted to you by these Terms.

You agree that you will not engage in, encourage, or assist others in reverse engineering, decompiling, disassembling, or otherwise attempting to derive the source code, underlying ideas, or algorithms of our Services or software. You shall not modify, create derivative works of, or attempt to access or use the Services or software in a manner inconsistent with the intended functionality or purpose. Any unauthorized use, copying, or distribution of our software or Services is strictly prohibited.

Account selling or any form of transfer or exchange of accounts is strictly forbidden. Any violation of this provision may result in the immediate termination of your account.

Furthermore, you agree that you will not run any promotions, contests, sweepstakes, or similar activities within the Skizzium Services without prior written authorization from Skizzium. Unauthorized promotions may result in immediate termination of user privileges and may incur other appropriate legal actions.

You agree to use the Services only for lawful purposes and in accordance with this Agreement. When using the Services, you will not upload, distribute, or transmit any content that is unlawful, infringing, defamatory, abusive, offensive, or otherwise objectionable.

All content you upload or submit through the Services, including but not limited to comments, user profiles, images, mods, and any other form of content, must adhere to our Content Policy. The Content Policy outlines the specific guidelines and restrictions regarding acceptable content on our platform. It is your responsibility to ensure that all content you upload or submit complies with the Content Policy.

You are solely responsible for the content you upload or submit through the Services. By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, translate, distribute, and display such content for the purpose of providing and promoting the Services.

Skizzium reserves the right to review and remove any content that violates this Agreement, our Content Policy, or is otherwise objectionable, without prior notice to you. We are committed to maintaining a safe and respectful environment for all users of our platform. The decision to remove content is at our sole discretion, and we are under no obligation to provide an explanation or justification for the removal.

You agree that you will not:

• Use the Services in a way that could impair or adversely affect the performance, availability, or functionality of the Services.
• Attempt to gain unauthorized access to another user's account or any non-public parts of the Services, including but not limited to attempting to circumvent any security measures or authentication systems.
• Upload or transmit any viruses, worms, malicious code, or other software intended to interfere with the operation of the Services, including its security-related features.
• Use the Services to violate applicable laws, regulations, or third-party rights, including but not limited to intellectual property rights.
• Use the Services in any manner that Skizzium reasonably believes to be an abuse or fraud.

We encourage you to report content or conduct that you believe violates these Terms or our Content Policy by opening a support ticket here . We also support the responsible reporting of security vulnerabilities. To report a security issue, please email [email protected] .

Skizzium and its licensors retain all rights, title, and interest in and to the Services, including all associated intellectual property rights. This Agreement does not grant you any right or license to use any trademarks, logos, or other proprietary information of Skizzium or its licensors.

By using the Services, you represent and warrant that you have all necessary rights to upload and share the content, including mods, and that the use of such content does not infringe or violate the rights of any third party.

Skizzium may display advertisements within the Services. You acknowledge and agree that the advertisements displayed are not controlled or endorsed by Skizzium.

Skizzium is not responsible for the content or accuracy of any advertisements displayed within the Services. Any interactions, transactions, or communications with advertisers are solely between you and the advertiser.

Skizzium respects your privacy and handles your personal information in accordance with its Privacy Policy. By using the Services, you consent to the collection, use, and disclosure of your personal information as described in the Privacy Policy.

Skizzium reserves the right to suspend or terminate your access to the Services at any time, with or without cause, without prior notice or liability.

Upon termination, all rights and licenses granted to you under this Agreement will immediately cease.

Skizzium reserves the right to suspend, restrict, or withdraw all or any part of the Skizzium website, desktop application, APIs, or Services without notice, for any reason, including but not limited to:

• Maintenance or updates to the Services;
• Security or technical issues;
• Compliance with applicable laws or regulations.

Skizzium shall not be liable to you or any third party for any suspension, restriction, or withdrawal of the Services. Skizzium also reserves the right to terminate your access to the Services at any time, with or without cause, and without prior notice.

In the event of any suspension, restriction, or termination of the Services, you acknowledge that Skizzium shall have no liability or responsibility to you or any third party for any loss, damage, or inconvenience caused.

You agree that Skizzium may assign or transfer its rights and obligations under these Terms to any affiliate, successor entity, or in connection with a merger, acquisition, restructuring, or sale of all or substantially all of its assets.

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. SKIZZIUM DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY. SKIZZIUM DISCLAIMS ALL LIABILITY AND MAKES NO REPRESENTATIONS OR WARRANTIES ABOUT THE ACCURACY, COMPLETENESS, SECURITY, OR RELIABILITY OF THE SERVICES OR THE CONTENT PROVIDED THROUGH THE SERVICES. ANY RELIANCE ON THE SERVICES OR CONTENT IS AT YOUR OWN RISK. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SKIZZIUM BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, REVENUE, DATA, OR USE, INCURRED BY YOU OR ANY THIRD PARTY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICES, REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, OR OTHERWISE), EVEN IF SKIZZIUM HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

SKIZZIUM'S AGGREGATE LIABILITY ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR THE SERVICES SHALL BE LIMITED TO THE AMOUNT YOU PAID TO SKIZZIUM, IF ANY, IN THE TWELVE (12) MONTHS PRIOR TO THE CLAIM GIVING RISE TO SUCH LIABILITY.

You agree to defend, indemnify, and hold harmless Skizzium and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses, including without limitation, reasonable attorneys' fees, arising out of or in any way connected with your use of the Services, your violation of this Agreement, or your violation of any rights of another party.

Skizzium reserves the right to modify or amend this Agreement at any time, in its sole discretion. Any modifications or amendments to the Agreement will be effective at a specified date or, if unspecified, immediately upon posting the updated terms on the Skizzium website or through the Services. Your continued use of the Services after the posting of any modifications constitutes your acceptance of the updated Agreement.

The Services may provide links or references to external resources, websites, or content that are not owned or controlled by Skizzium. Skizzium does not endorse or assume any responsibility for the content, privacy practices, or actions of any third-party websites or services. You acknowledge and agree that Skizzium shall not be liable for any loss or damage incurred as a result of accessing or using any third-party resources, websites, or content.

This Agreement constitutes the entire agreement between you and Skizzium regarding the Services and supersedes all prior agreements or understandings, written or oral.

If any provision of this Agreement is held to be invalid or unenforceable, such provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions of this Agreement shall remain in full force and effect.

By using the Skizzium Services, you acknowledge that you have read, understood, and agree to be bound by this Terms of Service Agreement.

This Agreement shall be governed by and construed in accordance with the laws of Bulgaria, without regard to its conflict of law principles. Any legal action or proceeding arising out of or relating to this Agreement shall be brought exclusively in the courts of Bulgaria. You hereby consent to the personal jurisdiction and venue of such courts and waive any objections to the exercise of jurisdiction over you by such courts.
